Terms of Service

1. Acceptance of Terms

By accessing or using AtanNote (the "Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the Service.

You must be at least 13 years old to use AtanNote. By using the Service, you represent that you are at least 13 years of age and have the legal authority to enter into these Terms. If you are using the Service on behalf of an organization, you represent that you have the authority to bind that organization to these Terms.

2. Description of Service

AtanNote is a voice-to-text note-taking application with AI-powered transcription, refinement, semantic search, and chat capabilities. The Service is available on web, iOS, Android, macOS, and Windows platforms.

3. Account Registration

To access most features, you must create an account with a valid email address. You are responsible for:

  • Providing accurate and complete registration information
  • Maintaining the security of your account credentials
  • All activities that occur under your account

Each person may maintain only one account. You must notify us immediately at support@atannote.com if you suspect unauthorized access to your account.

4. Subscription Plans & Billing

Free Tier

  • Guest users (no account): up to 5 notes
  • Registered users: up to 20 notes per month

Pro Tier

  • Unlimited notes, full access to all features
  • Includes a 14-day free trial for new subscribers

Billing by Platform

  • Web & Windows: Billed through Stripe. Subscriptions auto-renew unless cancelled from your account settings. You may cancel at any time; access continues until the end of the current billing period.
  • iOS & macOS: Billed through Apple App Store. Subject to Apple's terms and conditions. Manage your subscription through Apple settings.
  • Android: Billed through Google Play. Subject to Google's terms and conditions. Manage your subscription through Google Play settings.

Pricing may vary by platform due to platform fees. Refunds are subject to the refund policies of the respective payment platform (Stripe, Apple, or Google).

5. User Content & Intellectual Property

Your Content

You retain full ownership of all content you create using AtanNote, including audio recordings, transcriptions, notes, and AI-refined text. We claim no ownership over your content.

License to AtanNote

By using the Service, you grant AtanNote a limited, non-exclusive license to process, store, and display your content solely for the purpose of delivering the Service to you. This license terminates when you delete your content or account.

AI-Generated Output

AI-generated outputs (transcriptions, refined text, chat responses) belong to you. However, please note that AI-generated content may not qualify for copyright protection under current intellectual property law in some jurisdictions. Your content is not used to train AI models.

AtanNote Property

AtanNote owns all rights to the platform, including its code, design, branding, trademarks, and documentation. Nothing in these Terms grants you any right to use our branding or intellectual property beyond normal use of the Service.

6. AI-Powered Features

AtanNote's transcription, refinement, and chat features are powered by Google Gemini. While we strive for accuracy, AI-generated content may contain errors, inaccuracies, or omissions. You are responsible for reviewing all AI-generated content before relying on it.

AtanNote is not a substitute for professional services including, but not limited to, legal, medical, financial, or translation services.

7. Acceptable Use

You agree not to:

  • Use the Service for any illegal or unauthorized purpose
  • Upload or record content that is harmful, threatening, abusive, or infringing
  • Attempt to reverse engineer, decompile, or disassemble the Service
  • Use automated tools, bots, or scrapers to access the Service
  • Circumvent usage limits, rate limits, or access controls
  • Interfere with or disrupt the Service or its infrastructure
  • Impersonate any person or entity, or misrepresent your affiliation

8. Service Availability

We provide the Service on a "best effort" basis. We may modify, suspend, or discontinue any part of the Service at any time. For significant changes, we will provide reasonable advance notice. We are not liable for any downtime, interruptions, or loss of data resulting from circumstances beyond our reasonable control.

9. Privacy

Your use of the Service is also governed by our Privacy Policy, which describes how we collect, use, and protect your personal information.

10. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

We do not warrant that AI-generated transcriptions, refinements, or other outputs will be accurate, complete, or error-free. We do not guarantee uninterrupted or secure access to the Service.

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, ATANNOTE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, OR GOODWILL ARISING FROM YOUR USE OF THE SERVICE.

OUR TOTAL LIABILITY FOR ANY CLAIMS RELATED TO THE SERVICE SHALL NOT EXCEED THE AMOUNT YOU PAID TO ATANNOTE IN THE 12 MONTHS PRECEDING THE CLAIM.

12. Indemnification

You agree to indemnify and hold harmless AtanNote, its officers, employees, and agents from any claims, damages, losses, or expenses (including reasonable legal fees) arising from your use of the Service, your content, or your violation of these Terms.

13. Termination

You may delete your account at any time from within the app. We may suspend or terminate your account if you violate these Terms or engage in activity that harms the Service or other users.

Upon termination, your right to use the Service ceases immediately. We will delete your data in accordance with our Privacy Policy.

14. Governing Law & Disputes

These Terms shall be governed by and construed in accordance with applicable law. Any disputes arising from these Terms or the Service shall be resolved through good-faith negotiation first. If a resolution cannot be reached, disputes shall be settled through binding arbitration or in a court of competent jurisdiction, as determined by applicable law.

15. Changes to Terms

We may update these Terms from time to time. We will provide at least 30 days' notice of material changes via email or an in-app notice. Your continued use of the Service after the updated Terms take effect constitutes acceptance of the changes. If you do not agree to the updated Terms, you must stop using the Service.
